General Terms and Conditions

This document sets out the terms and conditions (“Terms and Conditions”) that govern your use of this site, registration with Expert Tuition, and your use of Expert Tuition’s Products and services.

Unauthorised Use of Expert Tuitions’ website, products and services:

You may not utilise our website, services or products in any manner which could compromise the security of Expert Tuition’s networks whatsoever, which shall include, gaining or attempting to gain unauthorised access to our website, services or products, or delivering or attempting to deliver any unauthorised, damaging or malicious code to our website, all of which is expressly prohibited. Any person or entity which does so, or attempts to do so, shall be held criminally liable. Furthermore, should Expert Tuition suffer any damage or loss due to unauthorised use, Expert Tuition shall be entitled to claim civil damages against you.

Liability/ Indemnity: 

Expert Tuition will not, under any circumstances be liable for any cost, claims, damages (including, without limitation any indirect or consequential loss (such as loss of profits, business, goodwill, revenue or anticipated savings) or other damages of any kind, penalties, actions, judgments, suits, expenses, disbursements, fines or other amounts that you or any third party might suffer that relates to or arises from your use of Expert Tuition’s site, products or services. To the fullest extent permissible by law, you agree to indemnify Expert Tuition, its affiliates, shareholders, directors, agents, consultants or employees harmless in respect of any claim that a third party might bring against us that relates to or arises from these Terms.

Interruption of Expert Tuition Website:

You acknowledge and agree that from time to time, the Expert Tuition Website may be inaccessible or inoperable, by reason of one or more of the following: 

    • Equipment malfunctions or faults;
    • Periodic maintenance procedures, downtime, or repairs that we may undertake from time to time; and
    • Causes beyond our control, including, without limitation, interruption or failure of telecommunication or digital transmission links, attacks on the network and network congestion or other failures.

Such interruption to the accessibility of the Expert Tuition Website will not be deemed a breach of this Agreement under any circumstances whatsoever and we will not be liable to you for any costs, claims or damages that you may sustain or suffer as a result of any interruption, inoperability or inaccessibility of the Expert Tuition Website.

Intellectual Property:

All copyright and other intellectual property rights in all content, trademarks, software, data, material, including logos, databases, text, graphics, icons, hyperlinks, confidential information, designs, agreements, and multimedia works, whether registered or unregistered and published on or via our Website (“proprietary material”), are the property of, or are licensed to, Expert Tuition and as such are protected from infringement by local and international legislation and treaties. The contents of this Website may not be transmitted, transcribed, reproduced, stored or translated into any other form without our prior written permission. 

Expert Tuition authorises you only to view, copy, temporarily download to a local drive, and to print the content of this Website, or any part thereof, provided that such content is used for personal purposes and for information purposes only, and such content is used for non-commercial purposes.

Warranties and disclaimers:

Expert Tuition makes no warranty or representation as to the availability, accuracy or completeness of the content of the Website. You expressly waive and renounce all your rights of whatever nature that you may have against Expert Tuition for any loss suffered by you, as a result of information supplied by Expert Tuition being incorrect, incomplete or inaccurate. All use and reliance on content and information provided through this Website will be at your own risk.

Expert Tuition may use the service of third parties to provide information on the Website. Expert Tuition has no control over this information and makes no representations or warranties of any nature as to its accuracy, appropriateness or correctness. The user agrees that such information is provided ‘as is’ and that Expert Tuition will not be liable for any losses that may arise from the user’s reliance on it, however these may arise.

Expert Tuition does not warrant that its website, products or services will be error free or that they will meet any criteria of performance or quality. Expert Tuition expressly disclaims all implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, compatibility, security or accuracy.

Whilst Expert Tuition has taken all reasonable measures to ensure the integrity of the Website and the contents thereof, no warranty, whether express or implied, is given that any files, downloads or application available via the Website are free of viruses, or any other data or code which has the ability to corrupt, damage or affect the operation of the user’s system. You will be exclusively responsible for any damage caused to your software or computer systems and/or any resulting loss of data caused as a result of any use of this Website.

Complaints and Dispute Resolution

Any dispute that you may have in relation to Expert Tuition, should be submitted to Paul Yon who shall endeavour to review and investigate the complaint, within five (5) Business Days after it having been referred to them.

You may be required to provide supporting documentation or other evidence that may be relevant so that Expert Tuition can fully investigate the complaint. Once the matter has been investigated, and due process followed, you will receive a written response informing you of the feedback, outcomes or suggested course of action related to the complaint.

Student Terms and Conditions

It is a condition of your registration as a student, that you agree to be bound by, and to abide by, the Terms and Conditions for all users and more specifically, the Terms and Conditions applicable to Students. 

If you are under the age of 18 years, you must obtain PRIOR WRITTEN permission and consent from your parents’ or legal guardians’ before purchasing any products or services.

Expert Tuition reserves the right, in its sole discretion, to amend and/or replace any of, or the whole of, the Terms and Conditions. Such amendments shall supersede and replace any previous Terms and Conditions and will be provided to you by way of online notification. 

REGISTERING WITH EXPERT TUITION:

In order to register with Expert Tuition, you are required to create an account and provide all information in relation thereto. It is your sole responsibility to ensure that the information you provide Expert Tuition with, is accurate and up to date. All your personal information will be processed in accordance with our Privacy Policy.

In order to complete your registration with Expert Tuition, you will be required to “tick the box” marked “I agree to the Student Terms and Conditions”, thereby agreeing to be bound by, and to abide by, these Terms and Conditions, any other policies referred to on our website.

What do you need to register with Expert Tuition:  

    • A current email account;
    • Access to a computer, laptop, iPad or smart phone;
    • Internet access; and
    • A digital copy of your identity document (national ID card), or passport, or government issued driver’s license.

Accessing Expert Tuition’s website, services and products:  

After successfully registering with Expert Tuition, and paying the applicable fees, you will be granted a limited, personal, non-exclusive, non-transferable and revocable license to use Expert Tuition’s services and products, including services associated therewith.

At all times, Expert Tuition reserves its right to suspend your access to its services and products until such time as all outstanding payments due to Expert Tuition have been paid by you.

Unauthorised Use of Expert Tuitions’ website, products and services:

You hereby agree to take full responsibility of your access and usage on Expert Tuition’s website, you agree to contact us immediately if you experience any unauthorised use of your profile details on our website. While Expert Tuition takes all reasonable security precautions, no liability will lie with Expert Tuition for damage caused by the malicious use of our website or by destructive data or code that is passed on to you through the use of the Expert Tuition website and its products and services.

In order to ensure the security and reliable operation of the services to all Expert Tuition’s students, Expert Tuition hereby reserves the right to take whatever action it may deem necessary to preserve the security, integrity and reliability of its network and back-office applications.

Any user who commits any of the offences detailed in Chapter 13 of the Electronic Communications and Transactions Act 25 of 2002 (“ETCA”) (specifically sections 85 to 88 (inclusive)) shall, notwithstanding criminal prosecution, be liable for all resulting liability, loss or damages suffered and/or incurred by Expert Tuition and its affiliates, agents and/or partners.

You, the user of our website, products and services, are responsible for any misuse of Expert Tuition’s online services that occurs through your account. It is the user’s responsibility to ensure that unauthorised persons do not gain access to or misuse Expert Tuition’s service.

Information provided to Expert Tuition:

By submitting reviews, comments and/or any other content (other than your personal information) to Expert Tuition for posting on the Website, you automatically grant Expert Tuition the right to use, reproduce, publish, translate, copy and distribute such content in whole or in part, and to incorporate it in other works in any form, media, or technology now known or hereinafter developed. 

ONLINE COURSES:

Content and relevance: 

It is your duty as the student to make sure the course you register for meets your requirements. You are required to go through the course pack thoroughly before registering.

Expert Tuition will not, under any circumstances guarantee the relevance of the course material to you, nor your ability to get employment or a promotion as a result of completing any course.

Course material: 

All course material, administration and instructions are in English.

What will you need to access and view course material: 

  • Adobe PDF Reader to read course material.
  • Adobe Flash Player to view the video lectures, resources and activities available in each Course module.
  • Microsoft PowerPoint to view presentations
  • Microsoft Word to read and create documents

* Additional resources: Should certain courses require additional software and resources, you will be informed of this on registration of that course.

* Disclaimer: Please note that all software and resources required for course completion is at your own cost.

Course delivery: 

Only students who are registered for a Course may participate in that Course.

You may not disclose your username or password to any other person, nor may you permit any other person to participate in the Course on your behalf.  

You may not impersonate any other person in dealing with or accessing Expert Tuition’s website, products or services using another user’s username and password.

PRICING AND PAYMENTS 

  • Course fees: When you register for a Course, you agree to pay the applicable Course fee as per the Course Pack.
  • Tax Invoices will be sent electronically to the email address provided by you.
  • Payment of Value Added Tax (“VAT”): The advertised fee includes VAT, your invoice will clearly indicate the prevailing VAT rate applicable.
  • Payment Options: When you register for a Course you have the following payment options:  
  • A FULL payment of the course fee upon enrolling; or
  • A THREE months subscription commencing at the time of enrolment; or
  • A SIX months subscription commencing at the time of enrolment.
  • Suspension for non-payment: If you fail to make payment for a Course by the due date, Expert Tuition reserves its rights to suspend your participation in the Course for non-payment. Should you fail to make payment within the prescribed time, Expert Tuition reserves its rights to deregister you from the course and you will forfeit all fees paid. The effect of being deregistered will also be noted on your academic transcript. Should payment be made within the prescribed time and your access to the course be resumed you take full responsibility for all time lost during your suspension. 

OUTSTANDING FEES, CANCELLATIONS AND DEFERRALS

Cancellation of registration: 

If you wish to cancel your Course registration, you will need to contact us at info@expert-tuition.co.za or call +27 825636198, whereafter you will be required to complete and submit a cancellation of registration form.

Process for cancellation:

You have 7 (seven) calendar days from the date of your first payment to request a refund of any amounts paid by you in respect of the course. Your refund will be paid to you within 30 (thirty) days after us receiving and accepting your request for cancellation.

BREACH

In the event you commit any material breach of these Terms and fail to remedy the breach within 7 days after receiving a written notice to do so, Expert Tuition may terminate your participation in the Course for which you are registered, and you will not be entitled to a refund of any portion of the Course fee.

GENERAL CLAUSES:

Expert Tuition’s details: By registering for a Course with Expert Tuition, these Terms and Conditions form part of the contract between you and Converge Group (Proprietary) Limited, trading as Expert Tuition a company registered in South Africa with its address at 62 Kyalami Hill Estate, 40 Robin Avenue, Kyalami, South Africa.

Governing law and Jurisdiction: This Agreement shall be governed by and construed in accordance with laws of the Republic of South Africa.  The Parties agree that any dispute, controversy or claim arising out of or relating to this Agreement which cannot be resolved by negotiation between the Parties may only be submitted to Johannesburg courts, Gauteng for the purpose of enforcing any claim arising hereunder.

Whole agreement: These Terms and Conditions, together with the application form, constitute the whole of the agreement between yourself and Expert Tuition in relation your registration for a course. Only a written variation agreed to by both parties will be of any effect.

Severability: In the event that any part of these Terms and Conditions is found to be partially or fully unenforceable for any reason, such provision shall be struck out from these Terms and Conditions and the remaining provisions shall be enforced to the full extent of the law.

Assignment: These Terms and Conditions, and any rights and licenses granted in terms thereof, may not be transferred or assigned by you without the prior written consent of Expert Tuition, but any rights and licenses granted in these Terms and Conditions may be assigned by Expert Tuition without restriction.

No Waiver of Expert Tuitions rights: Expert Tuition’s failure to act with respect to a breach by you or others does not constitute a waiver of our right to act with respect to subsequent or similar breaches. 

By registering with Expert Tuition you agree and consent to the receipt of marketing communication from Expert Tuition, should you wish to ‘opt-out’ of any generic marketing communication, this may be done by clicking on the link “unsubscribe” at the bottom of the email.

Privacy Information

What personal data we collect and why we collect it

Comments
When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

Contact forms and Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. 

These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.  When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

Embedded content from other websites

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.  These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracing your interaction with the embedded content if you have an account and are logged in to that website.

Who we share your personal data with

We do not share your personal data with any party except as otherwise disclosed herein.

Processing of your personal data

Expert Tuition will process your personal data in order to:

  • Perform services in accordance with this agreement;
  • Operate and manage your account;
  • Monitor and analyse our services;
  • Contact you by email, SMS or other means to tell you about our products and services;
  • Carry out market research, business and statistical analysis
  • Comply with any lawful obligations we may have.

Protection of your personal data:

Expert Tuition will:

  • Treat your personal data as strictly confidential;
  • Take appropriate measures to ensure that your personal data is kept secure and is protected against unauthorised or unlawful processing, accidental loss, destruction or damage, alteration, disclosure or access;
  • Not retain your personal data longer than the period for which it is required, unless we are required by law to do so.

What automated decision making and/or profiling we do with user data

We do not use your data for any automated decision making or profiling purposes.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.  If you register on our website, we also store the personal information you provide in your user profile. You are able to see, edit, or delete your personal information at any time. Website administrators can also see and edit that information.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us, provided this is not required for purposes of using the services and products of Expert Tuition and provided it does not include any data we are obliged to keep for administrative, legal, or security purposes.
